GDPR compliant use of the BAU.CAMERA

Privacy

As a rule, only overview images are taken with the BAU.CAMERA , and the combination of shooting distance and focal length rules out the possibility of recognizing and identifying the persons depicted. No other personal data (such as license plate numbers) is recorded and transmitted, so the individual's right to informational self-determination is not affected.

In closer shooting situations, our addition ANONYMIZATION PERSONS is recommended. All identifiable persons on the images of BAU.CAMERA are automatically anonymized, as well as car license plates are made unreadable.

In addition, we can use the addition PIXEL to statically pixelate selected parts of the image, e.g. to make adjacent properties permanently unrecognizable.

Duty to inform

With the new Basic Data Protection Regulation (GDPR), companies and institutions have to inform about video surveillance based on Art. 13 GDPR . The use of our BAU.CAMERAs requires very specifically the signage and the publication of information on the subject on site at the construction site.

Two things are practical to implement on the construction site:

  1. Placing a sign at the entrance to the construction site: pictogram with camera symbol and the reference to video surveillance, as in the example at left
  2. Information paper with the following details directly next to the sign and additionally a copy of it in a central place, e.g. construction container, bulletin board or where the red dot for the construction permit also hangs

The following information must be published on the info paper:

  • Identity of the person responsible for video surveillance - name including contact details (Art. 13 para. 1 lit. a GDPR).
  • Contact details of the company data protection officer - if named, but then mandatory (Art. 13 Par. 1 lit. b GDPR)
  • Processing purposes and legal basis in keywords (Art. 13 para. 1 lit. c GDPR)
  • Indication of the legitimate interest - as far as the processing is based on Art. 6 para. 1 p. 1 lit. f GDPR (Art. 13 para. 1 lit. d GDPR).
  • Duration of storage (Art. 13 para. 2 lit. a GDPR)
  • Reference to access to further mandatory information pursuant to Art. 13 (1) and (2) GDPR (such as right to information, right to lodge a complaint, recipients of the data, if applicable).
